These Terms of Service ("Terms") govern your use of Barkway. By accessing or using Barkway, you agree to these Terms.

1. About Barkway

Barkway is a booking and business management platform for dog grooming businesses.

2. Your Account

You must:

  • Provide accurate and complete information.
  • Keep your login details secure.
  • Be responsible for all activity under your account.

You must not:

  • Use Barkway for unlawful purposes.
  • Attempt to access systems or data without permission.
  • Interfere with the operation or security of the platform.

3. Free Trial

We may offer a 30-day free trial.

  • No payment details are required to start.
  • Full core features are available during the trial.
  • Limited usage allowances (such as messaging credits) may apply.

At the end of the trial:

  • You must subscribe to continue using Barkway.
  • If you do not subscribe, access may be restricted or suspended.

4. Subscriptions & Billing

Barkway is a subscription-based service.

  • Subscriptions are billed in advance on a recurring basis.
  • Pricing is based on usage (such as booking volume), not features or number of users.
  • All paid plans include access to core features.

You agree to pay all applicable fees.

We may update pricing or introduce new plans. Changes apply from your next billing cycle.

5. Messaging & SMS

Barkway may provide messaging features, including SMS reminders.

  • Messaging is subject to usage limits or credits.
  • Additional usage may require payment.
  • SMS delivery depends on third-party providers and is not guaranteed.

You are responsible for:

  • The content of messages sent.
  • Ensuring you have permission to contact recipients.

6. No Refunds

All payments are non-refundable, except where required by law.

This includes:

  • Subscription fees.
  • Partial billing periods.
  • Unused time.
  • Unused messaging credits or allowances.

You may cancel at any time, but your subscription remains active until the end of the billing period. No refunds will be issued for unused time.

7. Cancellation, Billing Failures & Suspension

You may cancel your subscription at any time. Cancellation prevents future renewals, and your access will continue until the end of your current billing period.

Failed Payments

If a payment fails:

  • We will attempt to retry the payment.
  • We may notify you to update your payment details.

We provide a 14-day grace period following a failed payment.

During this period:

  • Your account will remain active.
  • You are responsible for resolving the payment issue.

Suspension

If payment is not successfully collected after the grace period, we may suspend your account and you may lose access to Barkway and its features.

Your account will remain suspended until:

  • Outstanding payments are settled, and
  • Your subscription is brought back into good standing.

Continued Non-Payment

If your account remains unpaid, we may terminate your subscription and we may delete your data in accordance with our data retention policy.

Data Retention After Cancellation

If you cancel a paid subscription:

  • We will retain your data for up to 9 months after cancellation.
  • This allows you to return or request a copy of your data.

Before permanent deletion:

  • We will make reasonable efforts to notify you.
  • You may request a copy of your data during this period.

After this period, your data may be permanently deleted.

Reactivation

If your account is suspended due to non-payment:

  • Access may be restored once payment is received.
  • We do not guarantee data will be retained indefinitely beyond the retention period.

Exceptional Circumstances

We understand that unexpected situations can arise.

At our discretion, we may:

  • Temporarily extend billing deadlines.
  • Offer short-term account relief or flexibility.

This is not guaranteed and is assessed case by case.

8. Data & Responsibilities

You are responsible for:

  • The data you store in Barkway.
  • Ensuring you have the right to collect and use your clients' data.

You retain ownership of your data.

We process data on your behalf to provide the service.

9. Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability.

We may perform maintenance or updates that affect access.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Barkway is provided "as is".
  • We are not liable for indirect or consequential losses.
  • Our total liability is limited to the amount you paid us in the previous 12 months.

Nothing limits liability where it would be unlawful.

11. Changes to the Service

We may update, improve, or modify Barkway at any time.

We may update these Terms from time to time.

Continued use of Barkway means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales.
